LearnTube
Terms of Service
Version 1.0 · Effective 1 July 2026 · Last updated 9 September 2026
These Terms of Service (the "Terms") are a legally binding agreement between you and BeNinja Solutions Private Limited, a company incorporated under the Companies Act, 2013 (CIN U80904MH2017PTC295152) with its registered office in Mumbai, Maharashtra, India, operating the LearnTube platform ("LearnTube", "we", "us" or "our"). They govern your access to and use of the LearnTube websites, applications, assessments, certifications, reports, hiring and evaluation tools, and any related services (together, the "Services").
By creating an account, connecting a third-party account such as GitHub, or otherwise using the Services, you accept these Terms. Acceptance by electronic means, including by clicking a button or completing a sign-in, is valid and binding under the Information Technology Act, 2000. If you do not agree to these Terms, do not use the Services.
1. Who we are and how to contact us
1.1 LearnTube is operated by BeNinja Solutions Private Limited. References to LearnTube in these Terms include our affiliates, officers, employees and authorised contractors acting on our behalf.
1.2 You can contact us at hello@careerninja.in. For matters relating to personal information, our Grievance Officer is identified in Section 14.9.
2. Definitions
2.1 "Account" means the LearnTube account you create or that is created for you when you sign in.
2.2 "Connected Account" means a third-party account you link to your Account, including a GitHub account connected through OAuth single sign-on.
2.3 "Repository" means a source-code repository, public or private, accessible through a Connected Account, together with its files, commit history, branches, tags, metadata and associated content.
2.4 "Covered Repository" means every Repository that is accessible to us through a Connected Account, from the time the Connected Account is linked and for as long as the access token permits, other than a Repository you have withdrawn under Section 11.
2.5 "Code Data" means the contents of Covered Repositories, together with any analyses, scores, metrics, classifications, extracted tasks, evaluation datasets or other derived works that we or a Partner create from them.
2.6 "Partner" means any third party with whom we or our affiliates have a written agreement under which it receives Code Data for the Permitted Purposes, including without limitation artificial-intelligence research laboratories, AI model and product developers, data curation, annotation, evaluation and benchmarking companies, research institutions, and their respective affiliates and contractors.
2.7 "Permitted Purposes" has the meaning given in Section 8.1.
2.8 "Reports" means the code quality reports, scores, grades, certificates, feedback, job-fit evaluations and similar outputs we generate for you.
2.9 "Personal Information" means information that relates to you and can identify you, directly or indirectly, including sensitive personal data or information as defined in the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules").
3. Eligibility and your Account
3.1 You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Services. We do not knowingly provide the Services to persons under 18.
3.2 You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Notify us promptly at hello@careerninja.in if you believe your Account has been accessed without authorisation.
3.3 You must provide accurate information when creating your Account and keep it up to date. We may suspend or terminate Accounts that contain false information or that are used in breach of these Terms.
4. The Services
4.1 LearnTube provides skills assessment, code analysis, certification, learning, and hiring-related services. Depending on the features you use, the Services may include: automated analysis of your Repositories; code quality Reports and grades; certificates evidencing assessed skills; evaluation of your suitability for roles and matching with employers and hiring partners; personalised feedback and learning recommendations; and participation in assessments, challenges and hiring games.
4.2 Reports are generated using automated systems, including machine-learning models and rule-based analysers. They are our assessment of your work at the time of analysis, provided to support your learning and career decisions. They are not a guarantee of employment, admission, or any particular outcome, and may contain errors or omissions.
4.3 We may add, change, suspend or discontinue any part of the Services at any time. Where a change materially reduces the Services available to you, we will use reasonable efforts to notify you in advance.
5. Connecting your GitHub account
5.1 Certain Services require you to connect a GitHub account through GitHub's OAuth authorisation. When you do so, GitHub issues us an access token with the permissions shown on GitHub's authorisation screen, which include read access to all Repositories in your account, public and private. We use that token to access and keep a copy of every Repository it permits, including contents and commit history, so that we can analyse your work, generate your Reports, and use the Repositories for the Permitted Purposes.
5.2 The access token does not expire, but you may revoke it at any time from your GitHub account settings. Revocation prevents us from retrieving any further data from GitHub; it does not, by itself, withdraw a Covered Repository under Section 11 or affect copies of Code Data already retrieved or delivered. We may refresh our copy, and pick up newly created Repositories, from time to time while the token remains valid.
5.3 Your use of GitHub is governed by GitHub's own terms. We are not responsible for GitHub's availability, or for changes GitHub makes to its authorisation model.
5.4 The connect screen states, directly beneath the Connect control, that by connecting you agree to these Terms and that we use your code for your analysis and Reports and may share it with AI partners for model training. Connecting your GitHub account is the affirmative act by which you grant the licence in Section 7 over all Covered Repositories. A plain-language explanation of Sections 7 to 12 is available at all times in your Account settings under "Shared code".
6. Repositories covered by the licence
6.1 All Repositories accessible through a Connected Account are Covered Repositories from the moment you connect. You do not need to select them individually. Public Repositories are included, although they contribute little to your Reports and are generally of no interest to Partners.
6.2 After connecting, you can see every Covered Repository, and its sharing status, in your Account settings under "Shared code". From there you may withdraw any Repository as described in Section 11.
6.3 If you would rather not license a particular Repository, withdraw it before it is delivered to a Partner. We will not deliver any Repository to a Partner within 3 days of the Connected Account being linked, so that you have a reasonable opportunity to review the list.
6.4 We record the date, time and Terms version at the moment you connect, the Repository identifiers retrieved, and every subsequent withdrawal.
7. Code Licence
7.1 Ownership. As between you and us, you retain all right, title and interest, including all intellectual property rights, in your Repositories. Nothing in these Terms assigns or transfers ownership of your code to us or to any Partner.
7.2 Grant. In respect of each Covered Repository, you grant to LearnTube, its affiliates and its successors and assigns a non-exclusive, worldwide, royalty-free, irrevocable (subject to Section 11), perpetual, sublicensable licence to access, retrieve, download, store, copy, reproduce, host, analyse, process, index, transform, adapt, annotate, and create derivative analytical works from the Repository and its contents and history, and to disclose, distribute and make available the Repository and such derivative works to Partners, in each case for the Permitted Purposes.
7.3 Sublicensing. We may sublicense the rights in Section 7.2 to Partners, and Partners may further sublicense to their own affiliates and contractors working on their behalf, in each case only for the Permitted Purposes and only under written agreements that impose confidentiality obligations no less protective than those in Section 8.3.
7.4 Nature of the licence. This licence is granted in consideration of the Services described in Section 9. It is not an assignment, an exclusive licence, or a sale of copyright. You remain free to use, publish, license, or delete your Repositories in any way you choose.
7.5 Term. The licence for a Covered Repository continues until you withdraw it under Section 11, except that it continues indefinitely in respect of copies of Code Data delivered to a Partner before withdrawal, and in respect of derivative works and trained AI systems created before withdrawal.
7.6 Moral rights. To the extent permitted by law, you agree not to assert any moral right of attribution or integrity against LearnTube or a Partner in respect of the use of Code Data for the Permitted Purposes. This does not prevent you from being credited where you have asked us to retain attribution under Section 10.2.
8. Permitted Purposes and Partners
8.1 Permitted Purposes means the following, and only the following:
(a) Providing the Services: operating, providing, maintaining, securing, personalising and supporting the Services and any product, feature or service we or our affiliates offer now or in the future, including analysing Covered Repositories to generate Reports, certificates, feedback, job evaluations and learning recommendations.
(b) Developing our business: researching, designing, developing, testing, training, evaluating, benchmarking, improving and commercialising our and our affiliates' current and future assessment methods, analysers, machine-learning models, datasets, benchmarks, products and services; creating, licensing and selling datasets, benchmarks, evaluation tasks and other works derived from Code Data; and any purpose reasonably related to any of the foregoing.
(c) AI research and development by Partners: training, pre-training, fine-tuning, evaluating, benchmarking, red-teaming, aligning and otherwise developing or improving artificial-intelligence systems of any kind, including large language models, coding agents and related tools; creating evaluation tasks, benchmarks, annotations and datasets derived from Code Data; and research, development and commercial activities reasonably related to any of the foregoing.
(d) Job evaluation and matching, as described in Section 15.
8.2 Who Partners are. Partners include AI research laboratories and model developers, and data companies that curate, annotate, evaluate or supply data to such laboratories. Partners may be located outside India, including in the United States. We do not publish a list of Partners, but will tell you on request whether a specific organisation has received your Code Data.
8.3 What Partners may and may not do. Each Partner receives Code Data under a written agreement that: (i) limits use to the Permitted Purposes; (ii) requires the Partner to keep Code Data confidential and not to publish, sell, or redistribute your Repositories as such; (iii) prohibits use of Code Data to identify, contact or profile you as an individual; and (iv) requires reasonable security measures. Partners may retain and use Code Data, and AI systems trained on it, for the term of their agreement with us and, in respect of trained systems, thereafter.
8.4 What we cannot promise. An AI system trained on Code Data may, in rare cases, reproduce fragments of the code it was trained on. Once a model has been trained, Code Data cannot be extracted from it. We do not control how a Partner's trained systems are used by end users.
8.5 What we will not do. We will not sell your Personal Information to data brokers, and we will not use Code Data to serve you third-party advertising. Nothing else in this Section limits the Permitted Purposes.
9. What you receive
9.1 In consideration of the licence in Section 7, we provide the Services to you free of charge, including your Reports, certificates, job evaluations, matching with employers and hiring partners where you opt in, and feedback. You acknowledge that access to the Services is the sole consideration for the licence, and that the licence is a condition of using the Services that depend on Repository analysis.
9.2 We do not pay royalties, fees or any other amount for Code Data, whether or not a Partner accepts, uses or pays for it. Nothing in these Terms creates a partnership, agency, employment or profit-sharing relationship between you and us.
9.3 We may in future offer paid programmes or incentives for particular data contributions. Any such programme will be governed by its own terms and does not alter these Terms unless expressly stated.
10. Your identity in Code Data
10.1 Default: identity removed. Before delivering Code Data to a Partner, we replace author and committer names and email addresses in commit metadata with pseudonymous identifiers, and use reasonable automated measures to remove your name, email address and GitHub username from file contents such as README files, licence headers and configuration files. We do not share your LearnTube Account details or GitHub profile with Partners unless you ask us to under Section 10.2 or Section 15.
10.2 Option: keep attribution. You may ask us, through your Account settings or by email, to retain your name or GitHub username in Code Data delivered to Partners. If you do, Partners will receive that information and may use it for attribution within the Permitted Purposes.
10.3 Limits. Removal under Section 10.1 is best-effort and automated. Code, comments, test data or documentation you wrote may contain information that identifies you or others in ways our tools do not detect. Review your Repositories after connecting, and withdraw any containing information you do not want shared.
11. Withdrawing a Repository
11.1 You may withdraw any Covered Repository at any time from your Account settings under "Shared code", or by emailing hello@careerninja.in with the Repository name. Withdrawal takes effect within 5 business days.
11.2 Effect of withdrawal. After withdrawal, we will not deliver the Repository, or new derivative works created from it, to any Partner. We may retain our copy and continue to use it for the purposes in Sections 8.1(a) and 8.1(b), and as required by law or for the resolution of disputes.
11.3 Limits of withdrawal. Withdrawal does not affect: (i) copies of Code Data already delivered to a Partner; (ii) derivative works, datasets, benchmarks or trained AI systems created before withdrawal; or (iii) our right to retain the consent and withdrawal record under Section 6.4. We will tell you on request whether a withdrawn Repository had been delivered to any Partner before withdrawal.
11.4 Withdrawing all Covered Repositories, or revoking GitHub access, may prevent us from providing Reports and other Services that depend on Repository analysis.
12. Your warranties about your code
12.1 For each Covered Repository, you represent and warrant that:
(a) you are the sole author of its contents, or you hold all rights necessary to grant the licence in Section 7 in respect of any contents you did not author;
(b) no employer, client, university, or other third party owns or has an exclusive licence to its contents, whether under an employment contract, a work-for-hire arrangement, an assignment, a confidentiality obligation, or otherwise;
(c) its contents do not include third-party code whose licence prohibits, restricts, or imposes conditions incompatible with the licence in Section 7 (including code under licences that require attribution or source disclosure you have not satisfied);
(d) its contents do not include credentials, API keys, private keys, tokens, passwords, or other secrets, or the personal data of any person other than you;
(e) its contents do not include malware, or material that is unlawful, defamatory, or infringes any person's rights; and
(f) you have not misrepresented the authorship, history, or provenance of its contents.
12.2 If a Covered Repository does not meet these warranties, withdraw it under Section 11 before it is delivered to a Partner. If you become aware of a problem later, withdraw it immediately and notify us.
12.3 We rely on these warranties when delivering Code Data to Partners, and pass corresponding warranties to them. Section 21 sets out your responsibility if they prove untrue.
13. Repositories you must withdraw
13.1 Withdraw a Repository under Section 11 if any of the following applies to it: it was written in the course of your employment or under contract for a client; it is a fork, mirror or copy of another person's project to which you have made no or minimal contribution; it contains code generated by another person that you do not have the right to license; it contains secrets or the personal data of others; or it is subject to a non-disclosure or confidentiality obligation.
13.2 Allowing a Repository described in Section 13.1 to remain a Covered Repository is a material breach of these Terms.
14. Privacy
14.1 Our privacy policy. This Section, together with our Privacy Notice published on the Services, is our privacy policy for the purposes of the Information Technology Act, 2000 and the SPDI Rules.
14.2 What we collect. (a) Account information: your name, email address, phone number, and profile details you provide. (b) Connected Account information: your GitHub username, user ID and public profile, and the contents, history and metadata of Covered Repositories. (c) Commit metadata in Covered Repositories: author and committer names, email addresses and timestamps, which may relate to you and to other contributors. (d) Assessment information: your responses to assessments, challenges and hiring games, and the Reports we generate. (e) Usage information: device, browser, IP address and interaction data. (f) Hiring information: CVs and role preferences you provide.
14.3 Why we collect it. To create and manage your Account; authenticate you; retrieve and analyse your Repositories; generate Reports and certificates; evaluate you for roles and match you with employers and hiring partners where you opt in; communicate with you; operate, improve and develop the Services and our business; comply with law; detect and prevent fraud and misuse; and purposes reasonably related to any of these. Commit metadata is also processed to pseudonymise Code Data under Section 10 before delivery to Partners.
14.4 Who we share it with. (a) Service providers who host and process information for us, including cloud infrastructure providers such as Microsoft Azure. (b) Employers and hiring partners, in the circumstances described in Section 15. (c) Partners, in the pseudonymised form described in Section 10 unless you have chosen to retain attribution. (d) Authorities and other persons where required by law. We do not sell your Personal Information to data brokers.
14.5 Transfers outside India. Partners and service providers may be located outside India, including in the United States. We transfer Personal Information outside India only to organisations that maintain reasonable security practices, and in accordance with applicable law.
14.6 Security. We maintain reasonable security practices and procedures, including encryption in transit and at rest, access controls and logging, to protect Personal Information against unauthorised access, loss and misuse.
14.7 Retention. We retain Personal Information for as long as needed for the purposes in Section 14.3, and thereafter as required by law. Code Data is retained as described in Section 11.
14.8 Review, correction and withdrawal. You may review the Personal Information we hold about you and ask us to correct anything inaccurate, by emailing hello@careerninja.in from your registered email address. You may withdraw consent to further processing of your Personal Information by closing your Account; withdrawal does not affect processing already carried out, or Code Data already delivered to Partners, and may mean we can no longer provide the Services.
14.9 Grievance Officer. Gargi Ruparelia, Co-founder, BeNinja Solutions Private Limited, hello@careerninja.in. We will address grievances within one month of receipt.
14.10 Other contributors. Commit metadata in a Covered Repository may include names and email addresses of other people who contributed to it. By connecting a Connected Account you confirm that you are entitled to share that metadata with us for pseudonymisation and analysis. We pseudonymise all contributors' identifiers before delivery to Partners, not only yours.
14.11 Under-18s. The Services are not directed to persons under 18 and we do not knowingly collect their Personal Information. If you believe we hold Personal Information of a person under 18, contact the Grievance Officer.
15. Job evaluation and sharing with employers
15.1 Where you apply for a role through the Services, participate in a hiring game, or opt in to be matched with employers, we may share your Reports, scores, CV, contact details and, where relevant, Covered Repositories or extracts from them with the employer or hiring partner concerned, for the purpose of evaluating you for that role or similar roles.
15.2 Sharing under Section 15.1 is separate from sharing with Partners under Section 8, is not pseudonymised, and takes place only where you have applied or opted in. You may withdraw from job matching at any time in your Account settings.
15.3 Employers and hiring partners are responsible for their own use of information we share with them. We do not guarantee that any employer will consider or contact you.
16. Our intellectual property
16.1 The Services, including our software, assessment frameworks and methodologies (including the P.E.A.K.S. framework), scoring models, Report formats, certificates, trademarks, and all content we create, are owned by us or our licensors and protected by intellectual property laws. Except as expressly stated, these Terms grant you no rights in them.
16.2 Reports and certificates are provided for your personal use. You may share them with prospective employers and on professional networks. You may not alter them, remove our marks, or represent an altered Report as authentic.
16.3 Derived works we create from Code Data under Section 7.2 — including scores, metrics, benchmarks, evaluation tasks and datasets — are owned by us, without prejudice to your ownership of the underlying Repositories.
17. Acceptable use
17.1 You must not: use the Services for any unlawful purpose; interfere with or disrupt the Services or their infrastructure; attempt to gain unauthorised access to any part of the Services or to other users' data; submit false, misleading or fabricated information, including Repositories with artificially generated commit histories or authorship; use automated means to access the Services except through interfaces we provide; or reverse-engineer our assessment methods.
17.2 We may investigate suspected breaches and take any action we consider appropriate, including removing content, suspending or terminating Accounts, and reporting to authorities.
18. Suspension and termination
18.1 You may close your Account at any time from your Account settings or by emailing hello@careerninja.in. Closure withdraws all Covered Repositories under Section 11, subject to the limits in Section 11.3.
18.2 We may suspend or terminate your Account, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the Services. Sections 7.5, 8.3, 11.3, 12, 16, 19, 20, 21, 23 and 24 survive termination.
19. Disclaimers
19.1 The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
19.2 Reports, scores, grades and job evaluations are automated assessments. They may be incomplete or inaccurate, may not reflect your actual abilities, and are not a professional, academic or employment credential except where a certificate expressly states otherwise. You are responsible for decisions you make in reliance on them.
19.3 We do not warrant that the Services will be uninterrupted, secure or error-free, or that any defect will be corrected.
20. Limitation of liability
20.1 To the fullest extent permitted by law, LearnTube and its directors, officers, employees, agents and Partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with these Terms or the Services, however caused and under any theory of liability.
20.2 Our total aggregate liability to you for all claims arising out of or in connection with these Terms or the Services will not exceed INR 10,000 or the amount you paid us in the twelve months before the claim, whichever is greater.
20.3 Nothing in these Terms limits liability that cannot be limited under applicable law.
21. Indemnity
21.1 You will indemnify and hold harmless LearnTube, its affiliates, and its and their directors, officers, employees and agents, and each Partner, from and against all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) any breach of the warranties in Section 12; (b) any claim that a Covered Repository, or its use for the Permitted Purposes, infringes or misappropriates the rights of any third party, including an employer, client, or open-source licensor; (c) your breach of these Terms; or (d) your violation of any law or the rights of any person.
21.2 We will notify you of any claim for which we seek indemnity and may, at our option, assume control of its defence.
22. Changes to these Terms
22.1 We may amend these Terms from time to time. We will post the amended Terms with a new version number and effective date, and will notify you by email or in-product notice at least 15 days before material changes take effect.
22.2 Your continued use of the Services after the effective date of an amendment constitutes acceptance of the amended Terms, including in respect of Repositories that became Covered Repositories before the amendment. If you do not agree to an amendment, close your Account before the effective date.
23. Governing law and disputes
23.1 These Terms are governed by the laws of India.
23.2 Any dispute arising out of or in connection with these Terms will first be referred to good-faith negotiation between you and us for a period of 30 days from written notice. If unresolved, the dispute will be submitted to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
23.3 Nothing in this Section prevents either party from seeking urgent interim relief from any court of competent jurisdiction.
24. General
24.1 These Terms, together with any programme-specific terms we publish, constitute the entire agreement between you and us regarding the Services and supersede all prior agreements.
24.2 If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
24.3 Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent. We may assign them to an affiliate or a successor to our business.
24.4 Notices to us must be sent to hello@careerninja.in. Notices to you will be sent to the email address on your Account.
24.5 In the event of conflict between these Terms and any plain-language summary we display, these Terms prevail.
